TCEQ's air permit process evaluates air quality impact. It does not weigh in on siting, land use, water draw, or grid reliability, and its public comment window is far narrower than the scrutiny an equivalent public utility plant would face before breaking ground.

It's the same loophole we've flagged before: a Bexar County gas-and-diesel plant accused of splitting itself into smaller permits to dodge public review, and a Dallas-area company pitching a floating AI data center specifically because it skips both the ERCOT queue and a new water permit at once. Whether TCEQ or federal regulators revisit a permit of this size as national attention grows. What air quality actually looks like for Pecos County communities once 35 turbines are running, in a rural region with little existing industrial monitoring. And whether this becomes the template — gas-fired, off-grid, unconstrained by the ERCOT freeze — for the rest of Amazon's Texas buildout, or for competitors racing to avoid the same interconnection bottleneck.
